These guidelines ensure consistent, lawful, and respectful use of the KASNEB trademark and brand identity. They are grounded in theTrade Marks Act, Cap. 506, which protects registered marks against unauthorized use, misrepresentation or dilution.
2. Core Principles
- Distinctiveness: Our trademark is a unique identifier of our services and must not be altered.
- Integrity: Use must reflect kasneb’s reputation for professional education, certification and related purposes as per our mandate.
- Legal Compliance: All applications of the trademark must comply with the Trade Marks Act, Cap 506 and related rules and regulations enacted from time to time.
3. Proper Usage
- Exact Representation: Always use the official kasneb logo, name and colours as provided by kasneb.
- Contextual Accuracy: Use the trademark only in connection with authorized kasneb programs, certifications or partnerships.
- Attribution: Where appropriate, include ® or ™ to denote registered or unregistered status.
- Consistency: Maintain clear space around the logo; do not distort, rotate or recolour.
4. Prohibited Uses (Potential Infringement)
Infringement occurs whenever there is unauthorized use which is likely to create confusion or misrepresent origin. Examples infringement include:
- Unauthorized Commercial Use: Using the kasneb mark on goods/services without written authorised approval from the Accounting Officer.
- Misrepresentation: Suggesting endorsement, accreditation, or partnership with kasneb without its express consent.
- Alteration: Modifying the logo, name or slogan in ways that dilute its distinctiveness.
- Passing Off: Using similar marks, names or logos that could mislead the public into believing they are associated with kasneb.
- Domain/Online Misuse: Registering web domains or social media handles incorporating “kasneb” without prior written authorization.
5. Enforcement & Remedies
- Monitoring: kasneb reserves the right to monitor usage and take legal action against infringement and misuse.
- Legal Remedies: Infringement may result in injunctions, damages, or seizure/stoppage of infringing goods or services under the applicable laws.
- Reporting: Suspected misuse should be reported to kasneb or the Kenya Industrial Property Institute (KIPI).
